1. Payment and Deposits

All quoted prices are in Canadian Dollars (CAD) and are exclusive of applicable taxes, including GST, unless explicitly stated otherwise.

A non-refundable deposit equal to 30% of the total charter cost, or such other amount specified by Liard Air on the quote, is required to confirm a booking.

The remaining balance is due in full 24 hours prior to departure and is non-refundable in the event of client cancellation. Passengers who fail to present themselves at the designated departure time will be considered no-shows and will forfeit the full charter amount without refund.

EFT and wire transfer are the preferred methods of payment. Credit card payments may be subject to additional transaction fees, which will be charged to the client.

Overdue balances will accrue interest at a rate equal to the Bank of Canada rate plus 2% per annum, calculated monthly and compounded, from the due date until paid in full.

2. Quotes and Additional Charges

Charter quotes and invoices are valid until the specified date and are based on Jet A fuel priced at the rate stated in the quote. Any increase above this rate at the time of fuel uplift will be charged as a fuel surcharge, calculated using the applicable hourly fuel burn rate.

Additional airport and third-party charges, including but not limited to FBO services, de-icing, ground handling, and other operational costs, are not included unless specified and will be billed to the client at cost.

Hold time exceeding 50% of the chartered flight time, or any complimentary hold time stated in the quote, will be billed at the applicable hourly rate, pro-rated.

Flight crew are subject to Canadian Aviation Regulations (CARs) flight duty time limitations. Client-requested schedule changes that result in duty time exceedance may require additional crew, repositioning, delays, or other operational charges.

3. Flight Operations and Scheduling

All quoted charter times, including departure and arrival, are estimates only and are subject to pilot legal limitations, including flight duty time limits and weather minima, and to the sole discretion of the pilot-in-command in the interest of safety.

Charter operations are weather-dependent and may be delayed or cancelled for safety reasons.

A complete passenger manifest must be provided to Liard Air prior to departure. Passengers must arrive at the designated departure point at the specified time. Failure to do so may result in delays or cancellation without refund.

Liard Air reserves the right to substitute aircraft of similar capacity or performance when required for operational reasons.

4. Liability, Cancellations, and Force Majeure

Liard Air shall not be liable for delays, cancellations, or failure to perform due to events beyond its reasonable control, including weather, regulatory restrictions, mechanical issues not caused by negligence, or other operational factors.

Liability is limited to rescheduling the flight or refunding the unused portion of the charter, at Liard Air’s sole discretion. In the event of a refund resulting from a cancellation by Liard Air, any transaction fees and expenses incurred in connection with the charter will be deducted from the refund amount.

Liard Air is not liable for any indirect or consequential damages incurred by the client due to delays or cancellations.

To the maximum extent permitted by applicable law, Liard Air’s total liability arising out of or in connection with any charter, whether in contract, tort, or otherwise, shall not exceed the total amount paid by the client for the charter giving rise to the claim.

5. Passenger Conduct and Safety

The pilot-in-command retains full authority over the safety and conduct of the flight. Liard Air reserves the right to refuse carriage to any passenger who is intoxicated, disruptive, or non-compliant with crew instructions. No refund will be provided in such cases. Any diversion, unscheduled landing, or delay resulting from passenger conduct will be billed to the client.

6. Weight, Baggage, and Payload

Charter quotes are based on standard passenger and baggage weight assumptions. All passengers, baggage, and freight must comply with aircraft payload limitations as specified by Liard Air.

For standard charter operations, each passenger is permitted one piece of luggage not exceeding 20 in (50 cm) L, 32 in (80 cm) H, and 12 in (30 cm) W, with a maximum weight of 40 lbs. Soft or duffel-style bags are strongly recommended.

For backcountry or payload-based charters, total allowable weight is allocated as a combined payload of passengers and gear. In such cases, individual baggage limits do not apply, and all items are subject to weight distribution and aircraft loading requirements as determined by Liard Air.

Exceeding applicable limits may require adjustments to passenger count, baggage, fuel load, or flight scheduling and may result in additional charges. Liard Air reserves the right to verify passenger and baggage weights prior to departure to ensure compliance with aircraft limitations and applicable regulations.

7. Compliance and Dangerous Goods

Liard Air operates as an Air Taxi/Charter Service in accordance with Transport Canada regulations. All passengers must comply with applicable safety and conduct requirements.

Clients must notify Liard Air in advance of any dangerous goods to be carried onboard the aircraft. The client is responsible for ensuring that all passengers, baggage, and freight comply with applicable local, federal, and aviation regulations.

Items such as ammunition, bear spray, internal combustion engines, fuel, aerosols, and other hazardous materials must be declared in advance. If uncertain, clients must consult Liard Air prior to transport.

8. Insurance

Each passenger is covered under Liard Air’s aviation liability insurance policy, with coverage up to a maximum of $300,000 CAD per person for bodily injury or death arising from an aircraft accident or safety occurance.

9. Governing Law

These terms and conditions are governed by the laws of the Province of British Columbia and the applicable laws of Canada.

10. Acceptance

By confirming a charter booking, the client acknowledges and agrees to these terms and conditions in full.
